ENCINITAS – The City of Encinitas is ready to enter into a contract with a private company for parking services in response to the growing number of reported parking violations in the city center.
On March 23, the Encinitas City Council voted 5-0 to amend the existing city code, which allows the city to designate private individuals or entities to assist in parking enforcement efforts.
The Council must approve the amended rulebook a second time before it becomes applicable law, according to standard procedures.
According to Councilor Tony Kranz, the city has received numerous complaints from downtown business owners who have been negatively affected by the increase in parking violations outside their facilities.
Enforcement of the code is usually too busy to address minor parking violations of this magnitude, prompting the city to consider contracting with a private company, Kranz said.
“This is an issue that was primarily raised by downtown business owners, and the fact that the city has not implemented time limits for downtown parking makes there not enough traffic in the parking lot to encourage customers to come downtown,” Kranz said. “Instead, people will avoid companies there because they think there is no parking.”
By passing the amended ordinance, Kranz explained that a private person can facilitate executions by city officials and ensure that parking regulations are vigorously enforced.
“The reality is that both the sheriff’s department and the enforcement of the code have a lot of things to do, so giving priority to writing parking tickets for them is really not in the best interest of a city that functions smoothly,” Kranz said. “The idea is that with this ordinance, you contract the implementation of parking and thus do not require people who could investigate other crimes to spend their time writing sentences.”
The private retailer will primarily be tasked with securing parking in the Encinitas 101 Main Street neighborhood and near the Old Encinitas train station, said Councilor Joy Lyndes, although it is possible that the amended ordinance will be extended to other parts of the city.
The city has not yet identified a specific supplier to impose parking in the area. In addition, there is still no cost estimate related to outsourcing services, according to the city manager’s office.
Lyndes agreed with Kranz, expressing her opinion that the amended ordinance will give the city a lot more flexibility and control when it comes to, as she characterized, the somewhat chaotic parking situation in the city center.
“This gives us a lot more opportunities to implement, and we won’t necessarily use that, but we want those opportunities,” Lyndes said.
During the meeting, some residents expressed support for the amended ordinance, noting the inconvenience that the increase in parking violations has imposed on both locals and business owners.
Resident Tim Bratton said he was literally unable to retreat from his own driveway due to people being misplaced across the adjacent sidewalk, adding that he had contacted the sheriff’s department several times regarding the issue, but to no avail.
Scott Campbell agreed with Bratton and said he believes enforcing parking regulations will make downtown safer when it comes to homelessness issues, as well as improve the business climate.
“We have regulations to enforce,” Campbell said. “If we start enforcing our provisions on overnight [vehicles] and overnight camps, it will start to help us organically and economically in our homeless situation. There are people who are part of the problem, this will help the people we want here, not the people we don’t want here. “
But not all residents supported the amendment, including Joan Dodge, who shared her opposition to hiring a third party to implement city parking.
“Profitable, third-party law enforcement only infuriates citizens because the perception and reality that for-profit companies are encouraged to write more tickets for higher returns, which encourages abuse,” Dodge wrote in a public statement.
Dodge also asked why that agenda item did not have “fiscal consideration”.
“Really? Will a third party charge fines and keep them all free of charge to the city? Doesn’t the city consider collecting tickets as additional revenue to the city?”
Sherry Yardley, executive director of the Encinitas Chamber of Commerce, expressed support for the amended ordinance, noting that the organization received a series of recent complaints from local companies frustrated by the rise in parking violations and begging the city for more enforcement.
“I think most of our companies support this (provision),” Yardley said. “This is something we talked about with the E101 association and the city. So far, you only have parking in certain parts of the city, and a lot of our companies complain that people park in their areas and then go to other establishments, leaving visitors no parking space. ”
