“He proposed what they call the envelope design so that this residential building is wrapped around a six-story parking garage. So the project is literally a car-focused project, ”Vaughn said.

The multi-storey complex is expected to reach 69 feet, which is much higher than the city’s standard height of 39 feet. Vaughn says residents living in the rural community of Olivenhain are concerned about traffic congestion in the event of a fire.

“On the Rancho Santa Fe road, which is a two-lane highway running through the center of our village, there is such a spider web of small rural roads,” he said. “We’re evacuating” I have to get 6,000 Olivenhans through this.

The city refused permission in November and residents thought the project was blocked, but the developer sued.

Additional pressure came in the form of a letter from Attorney General Rob Bonte alleging that the city of Encinitas violated state housing laws by refusing a permit to build lower-income housing.

Bonta has threatened legal action if the amended plans are rejected again.

Last week, the city and developers reached an agreement to reduce the total number of units but increase the number of affordable units. Vaughn says he praises the increase in affordable units, but believes more studies are needed before anything is approved.

“I think the city needs to protect public safety in the first place. This requires a legitimate multilateral impact study involving all the key stakeholders there,” he said.

The group also has several lawsuits related to the project still pending.
