Encinitas takes the first step towards banning smoking in public places

ENCINITAS – City staff will review Encinitas’ smoking ban, with the possibility of future public safety ordinances coming out of the city’s Environmental Commission.

The Encinitas City Council voted unanimously on Sept. 21, with Councilwoman Kellie Hinze absent, to initiate a code change that will ban the smoking of all tobacco products in public areas.

The potential consequences of violating a potential change to the Encinitas Municipal Code would be a fee or other civil violation.

The motion also examined the legality of expanding the ban on moving vehicles on public roads.

The move comes from a recommendation from the Environment Commission, in efforts to identify and develop strategies to regulate sources of plastic pollution, as stated in the objectives of its work plan.

Several speakers from organizations such as Clean Earth 4 Kids, American Cancer Society, Surfrider Foundation and others spoke in favor of a code change. The council also received several letters of support from residents of the city.

Jim Wang, a former environmental commissioner, was one of the city’s advocates for change.

“We all know that smoking is not good,” Wang said, inspired by the current commissioner’s work. “[Cigarette filters] are tiny and loaded with these toxins that are so bad that cigarette companies don’t even want us to inhale them.”

Wang said there was no proper way to dispose of cigarettes and asked the city council to remove exemptions in the drafting of the workers’ ordinance. The motion developed a policy change that would eliminate smoking in public spaces, but exclude smoking in moving vehicles and private places.

“No matter how you dispose of that cigarette butt, it’s going to landfill at best,” he said, adding… “but it all ends up in the ocean.”

In introducing a potential ordinance, Commissioner Mark O’Connor said cigarette butts make up a large percentage of trash collected in coastal cleanups.

More than 35,000 cigarette filters were collected on Coastal Cleanup Day 2020, O’Connor said. The Surfrider Foundation reported collecting more than 52,700 filters from January 2019 to March 2020 at various San Diego County beaches.

Enacting a smoking ban, following 26 other cities in the state, would reduce pollution in the city and marine environment.

In its report to the City Council, the Environmental Commission said that the filters are made up of 15,000 microplastics, and “almost everywhere they are contaminating the food we eat, the water we drink and even the air we breathe”.

O’Connor told the council that cigarette butts are “a very easy pollutant for us to find,” adding that photos of the city’s filters shown during the presentation were not staged.

O’Connor added that only 9% of the state’s population smokes, but the remains of their habit make up 38% of the trash collected in the cleanup.

Thirty-five-year-old resident Nancy Logan, a representative of the San Dieguito Alliance for Drug-Free Youth, said children deserve to live in a drug/alcohol environment to “reach their full potential.”

Logan and other residents called on the city to go further, including removing exemptions for cars and private spaces.

“It is remarkable that the widespread littering of plastic products on public roads has never been normalized,” said Mayor Catherine Blakespear.

City staff will also review the legality of removing moving vehicles from the smoking ban.

Vice Mayor Joe Mosca also suggested directing the Environmental Commission to look into private property and cigarette butt bans for future consideration.
