Encinitas may extend the smoking ban to pavements and streets

It could become illegal to smoke anywhere but on private property in Encinitas under a proposal now under city review.

Acting on the recommendation of the city’s Environmental Protection Commission, the City Council directed city staff to draft an ordinance that would extend the city’s current ban on smoking in public places to sidewalks and roads. The vote was 4-0, with Council member Kellie Hinze not present.

“First and foremost, this is about public health” — the health of people and the health of the oceans, Councilman Joe Mosca said as he listed his reasons for supporting the proposal Wednesday, Sept. 21.

Mosca made his comments after Environmental Protection Commissioner Mark O’Connor held a slide show of photos of discarded cigarette butts on sidewalks, washed into drains and sitting on the beach. His presentation even included a cigarette butt used by a mother bird to feed her baby. He told the panel that he had no problem gathering evidence of cigarette waste for his presentation and warned them that when they started looking for cigarette waste, they too would see cigarette butts everywhere.

“It’s pretty easy. … The first storm drain I looked at was one that went right into … this is pollution that we can find very easily,” O’Connor said.

In fact, he said, it’s the number one trash picked up at beach clean-up events. Between January 2019 and March 2020, the Surfrider Foundation collected 52,722 cigarettes from San Diego County beaches. On a 5-minute walk from Cornish Drive to Swami’s Beach, you can find more than 250 discarded cigarettes, O’Connor said.

Encinitas already bans smoking in parks, beaches and trails. People are also prohibited from smoking inside or within 20 feet of the dining area on the restaurant’s outdoor patio. These bans have been in effect since 2014.

The new proposal would ban smoking on sidewalks, roadways or other public places. Once staff drafts the proposed ordinance, it will have to go back to the council for approval.

The Environmental Protection Commission recommended the council adopt an ordinance modeled after the one in Manhattan Beach, which prohibits smoking of all tobacco products in public places. Excludes private residential property and moving vehicles.

Council members asked why Manhattan Beach made an exception for people smoking in cars.

“Maybe it shouldn’t be an exception,” Council member Joy Lyndes said, noting that she believes a fair percentage of discarded cigarette butts found along roadways are thrown from vehicles.

City Attorney Tarquin Preziosi told her he would have to look into whether there was a legal reason for the exemption. If there is none, then let’s not include it, council members told him.

They also asked city staff to consider how enforcement would be handled, saying they wanted better compliance than they had with the city’s ban on gas-powered leaf blowers. Mosca said he wants a lot of education and public notice, “and very little fines early on.”
